- Affiliated to professional organisations
- Published author
What distinguishes an expert witness from an expert advisor?
An expert witness offers a specialized, independent opinion based on the directives provided to them. These directives form the basis of the Expert Witness Report, which is accessible to both the opposition and the Court. It's imperative for the Expert Witness Report to encompass all the details mandated by the Court Rules. The Court demands neutrality and objectivity from an expert witness, and any hint of bias could lead to the dismissal of their testimony.
Conversely, an expert advisor is engaged by a client to aid in shaping and refining a claim or defence strategy. Their primary allegiance is to the instructing party, not to the court, meaning they operate without the same expectation of impartiality that is required of an expert witness.
